Former Florida Supreme Court Justice Passes Away

Tallahassee, FL - December 30, 2012

Former Florida Supreme Court Justice Ben F. Overton died Saturday, December 29, in Gainesville, Florida, of complications from heart surgery. He was 86 and was Florida's 62nd Justice since statehood.

"Justice Overton was one of the most influential members of the Court after the sweeping reforms of the 1970s," said Chief Justice Ricky Polston. "He will be remembered not only for his far-seeing opinions but also for his efforts in the 1970s to make the state courts more accessible by allowing cameras into our courtrooms."

In the mid-1970s, Overton was one of several newly appointed Justices who elevated the reputation of the Court after it earlier had become involved in scandal. He was the first Justice chosen through a merit selection process created by Gov. Reubin Askew that soon was added to the Florida Constitution by vote of the people.

From his appointment on March 27, 1974, until his retirement on January 4, 1999, Overton authored more than 1400 decisions and was a central figure in a vast series of reforms that made his Court one of the most respected and accessible in the nation. He served as Chief Justice from 1976-1978 and chaired the Article V Review Commission in 1984.

He not only helped make Florida one of the first states to allow television coverage of court cases, but also was instrumental in making the state Supreme Court one of the first in the world to have a website. Overton later played a pivotal role in seeing that every Florida Supreme Court case was televised, webcast, and stored in an on-line archive.

Born in Green Bay, Wisconsin, Overton attended the University of Florida and later received his degree from its law school in 1952. He also earned an LL.M in jurisprudence from the University of Virginia in 1984.

Overton served nearly 10 years on the Pinellas County circuit court and, for several years, as its chief judge. He was well known for his work in legal education and dispute resolution and was Chairman of the Dispute Resolution Section of the American Bar Association. He was also an active adjunct professor of law at the University of Florida's Levin College of Law.

Predeceased by his wife Marilyn, Overton is survived by his children Judge William H. Overton, Robert M. Overton, and Catherine L. Overton; 2 grandchildren William E. and Brian H.; and one great grandchild, Adelynn.

Services will be held on Saturday morning, January 5, 2013 in Gainesville and Justice Overton will lie in state at the Florida Supreme Court on Monday, January 7, 2013. He will be interred in St. Petersburg, Florida on Wednesday, January 9, 2013.

Kyl was read a comment by Sen. John Cornyn (R-Texas), a top Republican who said recently that he expected $250,000 to be the agreed-upon level. "I believe we're going to pass the $250,000 and below sooner or later, and we really don't have much leverage there because those rates go up by operation of law Dec. 31. I would focus on the areas where we do have more leverage," Cornyn said.

But Kyl said that's no longer the case. "I don't think you have so many Republicans -- and the context of it was what is realistic as a deal. And the context of it was the president's adamant position that he wouldn't compromise on anything above $250,000. Let's just get back to the theory," Kyl suggested, ticking off arguments about the harm done to small businesses by a tax hike.

Graham said he won't support a "fiscal cliff" package that raises rates on income between $250,000 and $400,000 or $500,000, because he knows Democrats will cave on a higher threshold. He used the example of his fellow Fox guest, Sen. Dianne Feinstein (D-Calif.).

"No," he said when asked if he'd support the $250,000 level, "because she's willing to go for more, and why would I not find 4 or 500, because I know the votes are there for 4 or 500? But in the House, will the votes be there for 4 or 500?"

Feinstein flinched and, when pressed, put the onus back on the president, who was the first to raise the compromise level to income over $400,000. "We believe that the 250 threshold is the appropriate threshold. The president did make an offer, we understand, of 400,000, with a trillion in cuts accompanying it. That was turned down by the House," she said. "The time has come really to measure the absence of a deal against a deal. ... We have to solve this immediate situation."

Asked whether she'd accept the higher level, Feinstein was quick to answer. "I could certainly live with it," she said.

Sen. Charles Schumer (D-N.Y.), speaking on "This Week," said he thought a deal would come together after Jan. 3, when Rep. John Boehner (R-Ohio) is safely reelected speaker. "I am hopeful in the new year, after Speaker Boehner is elected -- reelected -- and he doesn't have to worry about those 50 [members of the Tea Party faction], that he will start working in a way like the Senate works, which is Democrats and Republicans together," said Schumer.

Last week, Senate Majority Leader Harry Reid (D-Nev.) said on the Senate floor that Boehner appeared more worried about holding his speakership than reaching a deal.

How did you two meet?

Kevin: Monica and I met while in New York, when we worked for Sony and Dreamworks. We started dating, found out we were both Catholic, and that was a good thing! While dating, we took another look at our lives, and both of us agreed we weren?t seeking the devout life as much as the "me" life. We slowly started coming back to the Church. The closer we got, the more we realized that if we were going to set our marriage on a solid foundation we couldn?t lead a double life anymore. Soon after our first child was born, we found ourselves walking more away from the secular side of the music business.

When you did that and founded Aim Higher Media in 2007, what was your goal?

Monica: We wanted to help artists, encourage them and make it be a positive art. It?s very difficult to get projects off the ground and things like licensing, and that?s what we?re trying to do. We had been involved in many projects in the past.

How did De Montfort Music evolve?

Monica: De Montfort Music came out of that (goal to make positive art). Kevin wanted to have a place for the religious orders to put their music out and not have to go directly to global entertainment companies. This gives them a good opportunity to have more ownership of their image and their music. Kevin came up with the great idea to have De Montfort Music so that these orders know they have a fertile haven for their music, but not let the world take too much of their life over. We?re the go-between between those two worlds.

The first project is the Benedictine Sisters? Advent at Ephesus. We gained a distribution deal through Decca, which is the largest classical-music distributor of that genre of music. It?s a wonderful collaboration. Our goal was to add into the culture some good and positive forms of entertainment not seen in recent times ? much like discovering a Michelangelo painting.

Kevin: One of the main reasons both Monica and I wanted to build De Montfort Music specifically around (religious) orders is that we felt these priories and monasteries are strong and vibrant. We met the Benedictines of Mary and saw how absolutely perfect their singing was ? it?s some of the most beautiful music you?ll hear, a slight view into heaven. It deepened our commitment of what we wanted for De Montfort Music.

How did you come to name your company after a saint?

Kevin: Our journey started with a very dear friend of ours, who was kind enough to educate us and to answer a lot of our questions. Out of these conversations, we were introduced to the book Aim Higher: Spiritual and Marian Reflections of St. Maximilian Kolbe by St. Maximilian Kolbe. That?s why we named the company Aim Higher.

His deep devotion to Our Lady led us to St. Louis de Montfort and his book that I got for a gift for Christmas for Monica, True Devotion to Mary. That book and St. Maximilian Kolbe led to consecrating ourselves to Our Lady and the enthronement of our home to the Sacred Heart.

How did the enthronement come about?

Monica: It was a book by Cardinal Raymond Burke, The Enthronement of the Sacred Heart of Jesus. We were very young in our family life, and, really, Cardinal Burke thought of everything. It?s a school, a way to walk you through the enthronement of a family. Kevin, being head of the domestic church, said that we should do this enthronement.

I had been a working woman in the world and around celebrities. To go from that to being a wife and mother and really letting someone else take the lead in the household, I didn?t even realize that was important. Kevin was to be the head of our domestic church.

I really do believe that enthronement brought us together in our marriage and our domestic church. Nothing has been as profound as this home enthronement, as carried out by Cardinal Burke?s book.

Kevin: It also encouraged me to go out and introduce myself to our pastor, join the Knights of Columbus, do the consecration to Our Lady and start Eucharistic adoration. A nice relationship developed with our pastor.

Monica: We never had a priest in our home because we didn?t feel we were holy enough. We had so much respect we didn?t want to burden them. But there?s no way to do this home enthronement effectively without a priest.

You specifically mention John Paul II?s motto ? "Totus Tuus" ? in relation to your company. How did he influence you?

Kevin: We noticed his love of Our Lady. And we noticed another thing: We had been working with rock stars, actors and famous people in the entertainment industry. In the world of live performance, that immediate feedback is very tempting ? our temptation to pride. When we saw John Paul II, we saw him up there with thousands of people in the audience, who were calling out, "John Paul II, we love you!" We were always wondering: How did he remain so humble? How did he do it (the constant humility)?

We learned more about his devotion to Our Lady. It?s the whole miracle of Our Lady of Fatima: Who among us can say we took a bullet for Our Lady?

Monica: How does someone get that way? That "Totus Tuus" is a big clue. You?ve got to know his devotion to Our Lady. That?s the secret of his success, and that?s what we discovered.

I understand you also had a saint connected with the album.

Monica: We tell people St. Th?r?se the Little Flower and St. Francis of Assisi are also on the CD. Their first-class relics were standing between Mother Cecilia, singing and conducting, and the choir of the sisters.

A lot of the proceeds are going to the sisters. They have the great "problem" of a growing order, and along with that comes debt. One of the other reasons we?re doing this (with De Montfort Music) is that we want to help relieve their debt. They?re all very young; it?s a very beautiful endeavor to support. There?s been debate in the scientific world for years over the role of genetic differences in the enzyme, known as CYP2D6. An estimated 5 percent to 7 percent of European and North American women have a trait that prevents the enzyme from working properly.

?Our findings confirm that, in early breast cancer treated with tamoxifen, genetic alterations in CYP2D6 lead to a higher likelihood of recurrence and death,? Dr. Matthew Goetz, a Mayo Clinic oncologist and lead author of the study that reported the findings, said in a Mayo Clinic news release.

The researchers tracked two groups of women: postmenopausal women with primary estrogen receptor-positive breast cancer who received tamoxifen for five years, and those took got the drug for two years followed by another drug, anastrozole, for three years.

Among those who took tamoxifen for five years, those whose genetic makeup prevented the enzyme from being able to process things were 2.5 times more likely to die or have their cancer return than those whose enzymes worked normally, the investigators found.

However, genetic traits involving the enzyme didn?t seem to influence the fates of the women who switched to anastrozole, an aromatase inhibitor, after two years of tamoxifen, the study found.

?Switching from tamoxifen to an aromatase inhibitor may be one reason for the discrepant studies surrounding CYP2D6 and tamoxifen ? as information about whether a patient took an aromatase inhibitor after tamoxifen was not available in most of the prior studies,? senior author Dr. James Ingle, of the Mayo Clinic, said in the news release.

Goezt thinks the study findings confirm that women should switch from tamoxifen to an aromatase inhibitor, or avoid tamoxifen altogether, if tests show they have the genetic trait that limits the metabolizing process.

The study was released online in advance of publication in an upcoming print issue of the journal Clinical Cancer Research.

Same-sex couples marry in Maine for first time

PORTLAND, Maine (Reuters) - The first gay and lesbian couples to wed under Maine's new same-sex marriage law exchanged vows early on Saturday in a series of spare but joyous civil ceremonies held shortly after midnight.

"We finally feel equal and happy to be living in Maine," an exuberant Steven Bridges, 42, said shortly after he and his newly wedded husband, Michael Snell, 53, became the first couple at City Hall in Maine's largest town to tie the knot.

After the pair had filled out the necessary paperwork, the city records clerk, Christine Horne, performed the brief, no-frills ceremony, pronouncing the two men married as they exchanged rings and kissed. Snell's two adult daughters, both from a previous heterosexual marriage, looked on smiling.

Other couples waiting in the hallway outside the clerk's office cheered the pair as they emerged, and a much larger crowd of about 250 supporters huddled in front of the building let out a jubilant roar as Bridges, a retail manager, and Snell, a massage therapist, stepped out into the cold night air.

A group in the crowd sang the Beatles song "All You Need Is Love," accompanied by several musicians playing brass horns, and many carried signs with such slogans as "America's new day begins in Maine" and "Love one another."

Nearby, a man who identified himself only as a local preacher shouted Bible verses.

"I'm here to speak for the Lord and to warn they need to repent," the man said. "They should turn from their ways. Even though man passed a law, doesn't mean God does."

Similar nuptial scenes were repeated inside as five more couples exchanged vows during the next two hours, and more weddings were expected before the office was scheduled to close again at 3 a.m. Newlywed couples were offered cupcakes as they left the building.

About 15 couples simply obtained their marriage licenses, with plans to wed later.

"We've been together for 30 years and never thought that this country would allow marriages between gay couples," said Roberta Batt, 71, an antiques dealer and retired physician with silver hair and round eyeglasses, as she and her longtime partner, Mary, waited their turn to wed.

"We're just very thankful to the people of Maine, and I hope the rest of the country goes the way this state has," she added.

TURNING THE TIDE

Maine, Maryland and Washington state became the first three U.S. states to extend marriage rights to same-sex couples by popular vote with passage of ballot initiatives on November 6.

But Maine was the only one of the three where voters did so entirely on their own, without state legislators precipitating a referendum by acting first.

Nine of the 50 U.S. states plus the District of Columbia now have statutes legalizing gay marriage. Washington's law took effect on December 9, and Maryland's law does so on January 1, 2013. Another 31 states have passed constitutional amendments restricting marriage to heterosexual couples.

City clerks' offices around Maine scheduled extra weekend office hours, some opening late Friday night as in Portland to accommodate same-sex couples rushing to wed as the new law went into force at 12:01 a.m.

More lavish same-sex weddings were being booked for the spring at the On the Marsh Bistro in Kennebunk, said owner Denise Rubin.

"We support it wholeheartedly," she said. "We look forward to being part of a whole new wave of wonderful thinking."

The tide of public opinion has been shifting in favor of allowing same-sex marriage. In May, President Barack Obama became the first U.S. president to declare his support for allowing gay couples to wed.

A Pew Research Center survey from October found 49 percent of Americans favored allowing gay marriage, with 40 percent opposed. The U.S. Supreme Court has agreed to review two challenges to federal and state laws that define marriage as a union between a man and a woman.

The nation's highest court said this month it will review a case against a federal law that denies married same-sex couples the federal benefits that heterosexual couples receive. It also will look at a challenge to California's ban on gay marriage, known as Proposition 8, which voters narrowly approved in 2008.

Maine's voter-approved initiative this year marked a turnaround from 2009, when legislators passed a statute recognizing gay marriage only to see it overturned that same year in a statewide referendum.

Madonna Builds 10 Schools In Africa

Pop superstar Madonna announced that her charity, Raising Malawi, built 10 schools in the country in 2012 and six of them are already in use.? Initially, the schools were supposed to take 18 months to build, with the last one going up in June 2013, according to News24; however, with help from partners at the non-profit buildON, they are six months ahead of schedule.? The four schools that aren?t already open will be ready to go by the first day of school in January, Madonna said.

With the opening of the schools, Raising Malawi noted that the schools would help an estimated 4,871 children receive an education.? Malawi is listed as one of the world?s least developed countries and only a very small portion of boys and girls are able to go to school so this undoubtedly help in a tremendous way.

This huge project seems to make up for Madonna walking away from the creation of a $15 million girls academy in Malawi back in 2009 after Raising Malawi was accused of financial mismanagement. Madonna dismissed it by saying she decided not to continue with that project because she wanted to be able to reach thousands of children, not hundreds of girls.

If you?re wondering why Madonna seems so closely connected to Malawi, it is because two of her children ? David and Mercy ? were both adopted from there.

This is a huge undertaking so here?s hoping Raising Malawi and buildON continue to make it successful for the sake of the children.

$1000 to transfer from public to private? - Adoption.com Forums

For somereason, a fellow foster peep tells me that it costs $1000 to transfer your "license" from a public to a private agency.

I'm thinking that this cannot be correct. I've heard about a "one time" copy fee that is permissible for a foster home study transfer. Perhaps she added $500 for an adoptive homestudy and an additional $500 for the foster home study. This figure is obviously not accurate, so I could use some help from y'all.

I've had people in my ongoing training classes who've transferred both ways--private to county and vice versa, but I've never asked them about the money. I know too that somethimes when you go to a straight "adoption only" agency, the adoption agency charges the applicant a fee and they will not accept a "county home study".

How many pages is an entire foster family file?
200 pages? 900? I'm not quite sure where she'd come up with such a high figure. If the file is 200 pages and it is
$00.35 per page, that is only $70 bucks.

How were foster files handled up there in Hamilton and Franklin County when everything went private? Were foster parents charged a transfer fee?

After Newtown, Americans want their guns, with some restrictions

(Reuters) - Nearly seven in 10 Americans support the idea of placing strong or moderate limits gun ownership following the mass shooting at Sandy Hook Elementary School, a Reuters/Ipsos poll said on Thursday.

But laws that permit citizens to carry concealed weapons or use lethal force for protection while in public were just as popular, the poll said.

The Reuters/Ipsos poll, which surveyed 1,477 Americans online between December 23 and 27, highlighted the difficulty U.S. policymakers face in devising ways to curb gun violence: gun control laws enjoy fervent support in the abstract, but laws preserving specific gun ownership privileges are also well liked.

The poll results come roughly two weeks after police say 20-year-old Adam Lanza shot his way into Sandy Hook Elementary School in Newtown, Connecticut, using a semi-automatic weapon to kill 20 first graders and six school staff members. Ahead of the rampage, he had killed his mother, Nancy Lanza, in their home five miles away. Lanza killed himself as police arrived at the school.

It was the second deadliest school shooting in U.S. history after the 2007 massacre at Virginia Tech University in Blacksburg, Virginia, which left 32 dead.

The Reuters/Ipsos survey found that 48 percent of respondents agreed that "gun ownership should have strong regulations or restrictions." Meanwhile, 69 percent and 68 percent either strongly supported or somewhat supported laws allowing law-abiding citizens to get a concealed-weapon permit and "laws allowing citizens to use deadly force to protect themselves from danger in public places," respectively.

Some restrictions on gun ownership enjoyed even more support than concealed carry rights. Nearly nine in 10 Americans favored laws requiring background checks before someone purchases a gun, and just over seven in 10 favored limits on the number of guns someone could purchase in a particular time frame.

But nearly four in 10 Americans said they supported allowing law-abiding citizens to bring a firearm into a "church, workplace, or retail establishment," according to the poll. Several states currently ban guns in such places.

An equal number said they were "very concerned" about increased purchases of semi-automatic weapons following the shooting in Connecticut, further illustrating the dissonance.

The latest poll results echoed attitudes expressed by Americans surveyed immediately after the Newtown massacre and differed sharply from Reuters/Ipsos polls conducted prior to it. The share of Americans supporting strong limits on gun ownership rose by 8 percentage points to 50 percent in the days after the shooting.

The poll's findings had a credibility interval, which is similar to a margin of error, of plus or minus 2.9 percentage points.

Animal rights group pays settlement in circus elephant case - WTVR 6

(CNN) ? A circus producer said Friday that an animal rights group has paid it $9.3 million to settle two federal court cases claiming elephant abuse.

Feld Entertainment, Inc., trumpeted the settlement with the American Society for the Prevention of Cruelty to Animals (ASPCA) as a victory for its Ringling Bros. and Barnum & Bailey Circus.

?These defendants attempted to destroy our family-owned business with a hired plaintiff who made statements that the court did not believe,? said Kenneth Feld, chairman and CEO of Feld Entertainment, in a statement.

?Animal activists have been attacking our family, our company, and our employees for decades because they oppose animals in circuses,? Feld said. ?This settlement is a vindication not just for the company but also for the dedicated men and women who spend their lives working and caring for all the animals with Ringling Brothers in the face of such targeted, malicious rhetoric.?

The ASPCA was one of several animal rights groups that sued Feld Entertainment in 2000, alleging that circus elephants were abused.

Both parties filed dismissal papers in U.S. District Court for the District of Columbia.

The ASPCA confirmed the settlement, saying in a statement that ?the organization does not admit to any liability or wrongdoing.? The court never ruled on the merits of the elephant abuse allegations, it said.

?After more than a decade of litigating with Feld Entertainment, the ASPCA concluded that it is in the best interests of the organization to resolve this expensive, protracted litigation,? said ASPCA President and CEO Ed Sayres in the statement.

Feld?s cases, which include allegations of litigation abuse and racketeering, will continue against the other defendants ? the Humane Society of the United States, the Fund for Animals, the Animal Welfare Institute, the Animal Protection Institute United with Born Free USA and Tom Rider, a former circus employee who testified against Ringling Bros.

U.S. District Judge Emmett G. Sullivan deemed Rider?s testimony tainted because he had been paid by animal rights activists and did not have standing to sue.

?The court finds that Mr. Rider is essentially a paid plaintiff and fact witness who is not credible, and therefore affords no weight to his testimony regarding the matters discussed herein, i.e., the allegations related to his standing to sue,? he wrote in a December 2009 opinion.

CNN was not able to reach Rider on Friday.

ASPCA spokeswoman Elizabeth Estroff would not comment on specifics of the case.

Friday?s settlement did not placate Wayne Pacelle, president and CEO of the Humane Society of the United States.

?While HSUS was not a party to the original case against Ringling, we agree with so many critics of the circus that its treatment of elephants is deplorable and unacceptable. We?ll continue to make our case to the public, even as Ringling files frivolous and retaliatory legal actions to divert and distract from its abuse of elephants,? he said in a statement.

John Simpson, lead counsel for Feld and a partner at Fulbright & Jaworski in Washington, said Feld?s legal costs since July 2000 have exceeded $20 million, but that settlements with other defendants may be reached.

?We?re going to see this through to conclusion, whether it ends in a verdict or whether it ends in a settlement,? he said in a telephone interview. ?But they know where to find me.?

The toll of the case has gone beyond a financial one, he said. ?It gets very personal and nasty out there on the line when the company?s employees are handling the elephants in public on walks,? he said. ?I think the people who have cared for these animals have suffered and been unjustly accused.?

Northeast cities could get up to 6 inches of snow

The snow flying in the Ohio Valley is moving into Philadelphia, New York and Boston, with three to six inches of snow expected in NYC. The Weather Channel's Chris Warren reports.

A second, smaller winter storm will hit the Northeast Friday night and into Saturday, dumping up to 6 inches of snow in major cities and up to a foot and a half of snow in less populated areas. But it won?t pack nearly the punch of the one earlier this week that brought twisters, high winds, icy roads, power outages and record snowfall, and that led to at least 17 deaths and thousands of grounded flights, affecting tens of thousands of holiday travelers.

"This storm will move at a rather brisk pace, so we don't expect any overwhelming snow amounts," weather.com reported.

The corridor from Philadelphia to New York City and Hartford, Conn., is expected to see snow totals in the 2 to 5 inch range, and more in the suburban and outlying areas, weather.com added. Boston?could see 4 to 6 inches of snow "if the low-pressure system tracks close enough to the coast."

For New York City, the snow should be just enough to create a "postcard" setting for sledding and strolling, NBCNewYork.com reported.

Washington, D.C., is looking at 1-3 inches, NBCWashington.com was forecasting. Some of that snow is likely to mix with rain.

Freezing rain -- making for treacherous travel conditions -- was predicted for parts of Maryland, Pennsylvania, Virginia and West Virginia while significant rain was likely along the New Jersey, Virginia and Maryland coasts, the?National Weather Service?said.

It won't be a blockbuster snowfall, but most of the big cities in the Northeast will get one to three inches of snow. The Weather Channel's Chris Warren reports.

The weather service forecast 12 to 18 inches of snow for northern New England, accompanied by freezing rain and sleet.

Tom Olney, a 50-year-old stay-at-home father of two, was making plans to go sledding with his children in their hometown of Wayland, Mass.?

"We love snow," Olney told Reuters. "What else are you going to do when it's this wet and cold out?"?

Western Massachusetts, like much of the Northeast, had an uncharacteristically mild winter last year, but residents such as Olney say they are ready for a more typical cold season.?

"Mother Nature doesn't usually give you two in a row," he said. "We've still got a lot of supplies from last year, so I guess we're ready for it now."?

Eleven inches of snow was forecast for Buffalo, N.Y., where some 8 to 12 inches of snow fell overnight into Thursday. Prior to that, Buffalo was 23 inches below average for this time of year, the weather service said.

"It's just a reminder: Winter is here," said Tom Paone of the National Weather Service in Buffalo.

The earlier winter storm was tied to at least 17 deaths and?forced the cancellation of thousands of airline flights. It?dumped record snow in north Texas and Arkansas before sweeping through the South on Christmas Day and then veering north, where the Adirondacks got 20 inches of snow.

More than 2,000 flights have been canceled, and more than 200,000 customers are without power in several Southern states as the impact of severe winter weather was felt across the nation. NBC's Eric Fisher reports.

It also triggered tornadoes and left almost 200,000 homes and businesses in Arkansas and Alabama lost power on Wednesday.

In Arkansas, 106,000 homes and businesses were still without power Friday afternoon, and the state's largest utility said many might not get it back until after Jan. 1.?

Deena Brazell spent a night in her car for warmth, though she hadn't planned it that way.

"Everything in the apartment is electric. I stayed in the apartment the first night. After that, it got cold really quick," she told The Associated Press. "I went out to charge the phone and fell asleep, then I just decided to stay."?

Russia's Putin signals he will sign U.S. adoption ban

MOSCOW (Reuters) - President Vladimir Putin signaled on Thursday he would sign into law a bill barring Americans from adopting Russian children and sought to forestall criticism of the move by promising measures to better care for his country's orphans.

In televised comments, Putin tried to appeal to people's patriotism by suggesting that strong and responsible countries should take care of their own and lent his support to a bill that has further strained U.S.-Russia relations.

"There are probably many places in the world where living standards are higher than ours. So what, are we going to send all our children there? Maybe we should move there ourselves?" he said, with sarcasm.

Parliament gave its final approval on Wednesday to the bill, which would also introduce other measures in retaliation for new U.S. legislation which is designed to punish Russians accused of human rights violations.

For it to become law Putin needs to sign it.

"So far I see no reason not to sign it, although I have to review the final text and weigh everything," Putin said at a meeting of federal and regional officials that was shown live on the state's 24-hour news channel.

"I intend to sign not only the law ... but also a presidential decree that will modify the support mechanisms for orphaned children ... especially those who are in a difficult situation, by that I mean in poor health," Putin said.

Critics of the bill say the Russian authorities are playing political games with the lives of children, while the U.S. State Department repeated its "deep concern" over the measure.

"Since 1992 American families have welcomed more than 60,000 Russian children into their homes, and it is misguided to link the fate of children to unrelated political considerations," State Department spokesman Patrick Ventrell said in a statement.

Ventrell added that the United States was troubled by provisions in the bill that would restrict the ability of Russian civil society organizations to work with U.S. partners.

Children in Russia's crowded and troubled orphanage system - particularly those with serious illnesses or disabilities - will have less of a chance of finding homes, and of even surviving, if it becomes law, child rights advocates say.

They point to people like Jessica Long, who was given up shortly after birth by her parents in Siberia but was raised by adoptive parents in the United States and became a Paralympic swimming champion.

However, the Russian authorities point to the deaths of 19 Russian-born children adopted by American parents in the past decade, and lawmakers named the bill after a boy who died of heat stroke in Virginia after his adoptive father left him locked in a car for hours.

Putin reiterated Russian complaints that U.S. courts have been too lenient on parents in such cases, saying Russia has inadequate access to Russian-born children in the United States despite a bilateral agreement that entered into force on November 1.

NATIONAL IDENTITY

But Putin, who began a new six-year term in May and has searched for ways to unite the country during 13 years in power, suggested there were deeper motives for such a ban.

"For centuries, neither spiritual nor state leaders sent anyone abroad," he said, indicating he was not speaking specifically about Russia but about many societies.

"They always fight for their national identities - they gather themselves together in a fist, they fight for their language, culture," he said.

The bid to ban American adoptions plays on sensitivity in Russia about adoptions by foreigners, which skyrocketed as the social safety net unraveled with the 1991 Soviet collapse.

Families from the United States adopt more Russian children than those of any other country.

Putin had earlier described the Russian bill as an emotional but appropriate response to the Magnitsky Act, legislation signed by President Barack Obama this month as part of a law granting Russia "permanent normal trade relations" (PNTR) status.

The U.S. law imposes visa bans and asset freezes on Russians accused of human rights violations, including those linked to the death in a Moscow jail of Sergei Magnitsky, an anti-graft lawyer, in 2009.

The Russian bill would impose similar measures against Americans accused of violating the rights of Russian abroad and outlaw some U.S.-funded non-governmental groups.
