Judge to rule in school finance lawsuit today | Trail Blazers Blog

State District Judge John Dietz is expected to issue a preliminary ruling in the Texas school finance case Monday after attorneys for the plaintiff school districts and the state offer their closing arguments. The case wrapped up last week, setting the stage for Dietz? decision and capping 12 weeks of testimony that began back in October. This will be Dietz? second major ruling on school finance, the first coming in a similar case a decade ago.

Attorneys for the four plaintiff groups ? representing more than 600 school districts ? will go first on Monday, taking most of the morning. They will try to bolster their claims that the school finance system is inequitable and does not provide enough funding for schools to meet all state and federal requirements. State attorneys will then counter that funding for schools is adequate ? a constitutional requirement ? and meets the legal standard for equity laid out in previous court rulings. Much of the testimony during the trial centered on the massive funding cuts that the Legislature imposed on public schools during the past two years

Whatever the ruling, the case will be appealed to the Texas Supreme Court, which will have the final say in the lawsuit. The high court is expected to hear the case later this year. Legislative leaders have made it clear that they will not move to revamp the school finance law short of a ruling from the Supreme Court, which handed down its last school finance decision in 2005. That order called for changes in the way schools were funded with property taxes and led to a massive reduction in school property taxes ? offset by higher taxes on businesses and smokers.
